On Sunday, Smith expressed gratitude to the governor and stated in a written statement that the pardon is evidence of the Governor’s acknowledgement that justice has been politicized and weaponized. He also declared that he will continue to advocate for parents and their children who are affected by misguided school policies.

He attended the board meeting in June 2021 because of his concern for her and other students’ safety, as well as the fact that he faced opposition from those who supported new bathroom policies and was unreasonably restrained by law-enforcement officers.

According to Biberaj, Youngkin’s assertion that the case should never have been prosecuted sends a message that deputies were lying about the facts, magistrates issued arrest warrants incorrectly, and special prosecutor Stafford was engaging in wrongful prosecution.
Last year, a Virginia circuit court judge recused Biberaj from her case after his attorney requested disqualification for the same reason. Smith’s attorneys claimed that she was unfairly accused of being discriminatory towards him and other parents who opposed the school system’regular transgender policies.
The judge, as per Biberaj, appointed a Republican prosecutor to ensure public confidence in the case.
The Loudoun County Sheriff’s Office spokesperson was not available for comment on Sunday, as Stafford County’ attorney assumed control of the case after Biberaj recused himself.
